What Is eIDAS and Why Does It Matter?

The Electronic Identification, Authentication and Trust Services regulation — universally known as eIDAS — came into force across the European Union in July 2016. It replaced a patchwork of conflicting national e-signature laws with a single, harmonized framework. The core promise: an electronic signature that is legally valid in one EU member state is legally valid in all of them.

For US businesses, eIDAS matters because the EU is the largest trading bloc in the world. The Three Tiers of eIDAS Electronic Signatures

Step 1 — Understand Simple Electronic Signatures (SES)

A Simple Electronic Signature is the broadest category. It includes typing your name at the bottom of an email, checking an "I agree" box, or using any tool that captures intent to sign without cryptographic verification. Step 3 — Understand Qualified Electronic Signatures (QES)

A Qualified Electronic Signature is the gold standard under eIDAS. It requires a QES certificate issued by an EU-approved Qualified Trust Service Provider (QTSP) and must be created using a Qualified Signature Creation Device (QSCD) — typically a hardware security key or a remote HSM provided by the QTSP. A QES has the same legal effect as a handwritten signature in all EU member states without exception.

QES is reserved for the most consequential documents: notarial acts, court filings in some jurisdictions, power-of-attorney instruments, and contracts where national law specifically mandates a handwritten signature.

Step 4 — Identify Which Level Your Document Needs

Most cross-border business documents between the US and the EU require only SES. A quick rule of thumb:

• SES is fine for: freelance contracts, NDAs, service agreements, employment offers, purchase orders, and most commercial contracts.
• AdES is often needed for: regulated financial products, real estate agreements in certain countries (Germany, Austria), and public-sector contracts above thresholds.
• QES is required for: specific notarial or statutory acts where national law mandates a handwritten equivalent. These are the exception, not the rule.

When in doubt, ask your EU counterparty's legal counsel which tier they require.

Step 5 — Sign Your Document With a Compliant SES Workflow
